Board of Ed rules required that Julio was to be escorted to the bus. The NYCTA denied liability, claiming they weren’t negligent because Julio ran after the bus. At trial, both the Board of Ed who had knowledge of Julio’s poor impulse control and was required to put him safely on the bus, and the NYCTA whose bus driver saw Julio running and made no effort to slow or stop the bus were found to be responsible.
